THCa flower is federally compliant under the 2018 Farm Bill when it contains less than 0.3% delta-9 THC on a dry-weight basis. At that threshold it is classified as hemp, not marijuana, and can be legally purchased, possessed, and shipped across most of the United States. However, several states have passed their own laws restricting or banning hemp-derived cannabinoids regardless of federal classification.
The 2018 Farm Bill removed hemp from the Controlled Substances Act and transferred oversight to the USDA. Under this framework, legality hinges on delta-9 THC content, not THCa content. Because THCa in its raw form is chemically distinct from delta-9 THC, flower with high THCa concentrations can still qualify as legal hemp.
This interpretation is increasingly contested. The DEA has indicated that a product's total THC, calculated by adding delta-9 THC to the THC produced when all THCa converts, may be the appropriate standard for determining legality. As of 2026, no final federal rule has been issued and enforcement against compliant hemp products remains uncommon. The landscape is likely to shift as Farm Bill reauthorization continues.

THCa flower ships to the remaining 43 states and Washington D.C., including California, Texas, Florida, New York, Colorado, Arizona, Illinois, Georgia, and most other major markets. A state having a licensed dispensary system does not automatically restrict THCa hemp products. Both can coexist legally in many states.
Even in states where THCa flower is legal to purchase, transporting it across state lines into a restricted jurisdiction is inadvisable. Law enforcement may not be able to distinguish compliant hemp from controlled cannabis without laboratory testing. Carrying your product's certificate of analysis can help, but it is not a guarantee of smooth passage at every checkpoint.
